Wiley: USDA, Senate farm bill approaches differ on foreign-owned farmland

The Trump administration’s proposed regulations implementing the Agricultural Foreign Investment Disclosure Act of 1978 (AFIDA) would expand current disclosure obligations, but the Senate farm bill scheduled for markup Thursday takes a somewhat different approach, the Wiley law firm said in an analysis released this week.
“The proposed rule reflects views by the Trump administration, Congress, and multiple U.S. states that certain foreign ownership of U.S. agricultural land and food systems presents national security concerns that must be addressed immediately,” the analysis noted.
The lead author of the analysis is Mary Beth Schultz, a Wiley partner who is a former acting general counsel and principal deputy general counsel at USDA.
